TERMS AND CONDITIONS OF SALE


  1. ORDERS: All orders should be done On-line web site. In cases where Internet access is not available, we will accept orders by Fax or email. Your on line orders will speed up our order processing, and keep the stock quantity up to date.

    * Sorry we do not process overseas orders.

  2. PRICING: All Prices quoted on the web page are current as of the date at the bottom of the page indicates. Errors and omissions excluded. The prices are not negotiable (except large quantity buy discount -- each item: quantity over 50) and all our retail prices include GST already but do not include shipping cost. All Prices are subject to exchange rate and subject to change without notice. Customers must expect to pay the prices listed on the price list at the time of order submission. If the specific item ordered undergoes a price drop, and we have not completed the paper work, then we will adjust to the new price accordingly. Otherwise, the customer will be invoiced the amount as submitted on the on-line order form or our price list. Please DO NOT contact us regarding a rebate in this situation. Such claims will be ignored. If the item(s) price gone up at the time we ordering the stock in, we will inform you then you can decide to go ahead with the new high price or cancel the item/order.

  3. GST:All the purchases from us are subject to GST which is already included in our price.

  5. WARRANTY:
    Online Marketing (Australia) Pty. Ltd. offers 12 months limited warranty on all goods NOT COVERED by the original manufacturer's warranty. This warranty extends to complete systems built by Online Marketing (Australia) Pty. Ltd., but DOES NOT extend to any second-hand or used goods and warranty (if any) is clearly stated on the page in which the item is advertised.

    1. Claiming Warranty: The following procedures are to be strictly followed, or the warranty claim will be deemed INCOMPLETE and will NOT be processed.

      1. Customers must use our On Line Fault Report Form to reports your problem to Online Marketing (Australia) Pty. Ltd. providing   NAME, ORDER ID NUMBER, PRODUCT/S ORDERED and a FAULT DESCRIPTION.

      2. Online Marketing (Australia) Pty. Ltd. staff will instruct you the course of action required.
        You must wait for instructions from us before you act.
        Actions undertaken without the consent of Online Marketing (Australia) Pty. Ltd. will be deemed void.

    2. Scope: Warranty will only extend to goods which are reasonable determined by Online Marketing (Australia) Pty. Ltd. to be in breach of warranty. Warranty can only be claimed by customers who deal directly with Online Marketing (Australia) Pty. Ltd.

      1. Warranty will not extend to:
        • Goods altered in Any way by ANY person(s) other than authorized by Online Marketing (Australia) Pty. Ltd. Technicians
        • Faults caused by NEGLIGENCE, IMPROPER USE OR MISUSE

    3. Remedies: Goods will be REPAIRED, REPLACED or . its value CREDITED to the relevant debtor at the SOLE discretion of Online Marketing (Australia) Pty. Ltd.

    4. Online Marketing (Australia) Pty. Ltd. WILL NOT BE LIABLE IN ANY WAY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS RESULTING FROM FAULTY SYSTEMS OR PARTS SOLD BY IT.

    5. We strongly recommends you use insurance and registered post when you send parcel to us.

  6. REFUND, RETURN & REPLACEMENT:

    Please choose your product/s carefully, we do not refund if you order the wrong product(s); but we may credit you with the value for exchanging to another product. special ordered; non-common item(s) excluded; In this case you must pay for the postage for the return and replacement of the item. A restocking fee will also apply if the package has been open. For more information please refer to the specific Software/Hardware return policies below (sections 6.1, 6.2 and 6.3).

    D.O.A (Dead On Arrival – within 48 hours after you receive a product) goods and faulty goods will be replaced free of charge. In this instance, customers agree to pay for all freight charges to and from Online Marketing (Australia) Pty. Ltd. For all faulty parts. Please allow 2-3 weeks replacement time depending on stock availability. Some items are covered direct from the vendors or factory, So do contact us before claim on D.O.A item(s).

    1. General Policies:
      • Credit or replacement of goods will be issued at the sole discretion of Online Marketing (Australia) Pty. Ltd
      • All Faulty items must be tested by Online Marketing (Australia) Pty. Ltd. technicians prior to replacement or refund
      • Not all Manufacturers/Suppliers offer D.O.A. policy. D.O.A replacements are at the sole discretion of the Manufacturer/Supplier. D.O.A replacements are at the sole discretion of the Manufacturer/Supplier
      • Unreasonable price or price of item on back order is subject to change
      • No goods will be accepted for return, refund or credit 7 days from the date of invoice processed.

    2. Commen Software Return Policies:
      • Faulty Media - Exchange for the same product only
      • Product/s unopened (under A$500 value) within 7 days (from invoice date) - Full Credit
      • Software CD or Floppy, package opened - Not Returnable
      • Box open, but all in new condition - 30% Restocking Fee
      • Manual/s removed from plastic wrapping - 50% Restocking Fee
      • Software Licenses or Academic Software - Not Returnable

    3. Common Hardware Return Policies:
      • Product/s Unopened (under A$500 value) within 7 days (from invoice date)- full credit
      • Box open, but all in new condition - 20% Restocking Fee
      • Manual/s removed from plastic wrapping - 30% Restocking Fee
      • Handling fee applies for every order return - $22 (GST incl.)
      • Consumables used - Not Returnable

  7. DELIVERY:Freight charges are to be PAID for by the customer. Customers may arrange freight if preferred.

    1. Online Marketing (Australia) Pty. Ltd. WILL NOT BE RESPONSIBLE FOR GOODS LOST OR ARRIVED DAMAGED if customers use their own couriers.

    2. All Shipment arranged by Online Marketing ( Australia ) Pty. Ltd. will be Insured if the value of the item(s) is/are over A$100.

  8. FEES: The following fees apply:

    1. Restocking fee of $10.00 or 20% of our SALES price, whichever is greater; applies for each NON-FAULTY item returned, for whatever reason.

  9. Data Protection:

    1. We will use your details for fraud prevention purposes. We will check your details with fraud prevention agencies and if you give us false or inaccurate information and we suspect fraud, we will record this.

  10. RESERVATION OF TITLE: Title in all goods remain with Online Marketing (Australia) Pty. Ltd. until payment has been received in full.

    1. Until title passes, Online Marketing (Australia) Pty. Ltd. can retain, repossess and/or resell all goods.

    2. Customers acknowledge that they hold all goods from Online Marketing (Australia) Pty. Ltd. as bailees until title passes.
